Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Jobseeker", "User") and ShiftHain Technologies Private Limited ("ShiftHain.Com", "Company", "we") governing your use of the ShiftHain.Com platform (website, mobile application, and related services).
By creating an account or using the platform, you agree to these Terms in accordance with the Indian Contract Act, 1872.
1. Eligibility & Registration
- You must be at least 18 years of age to register on ShiftHain.Com.
- You must be legally competent to enter into a contract under the Indian Contract Act, 1872.
- You must provide accurate, current, and complete information during registration.
- You must maintain and update your information to keep it accurate.
- One account per individual is permitted; duplicate accounts may be suspended.
2. Account Security
- You are responsible for maintaining the confidentiality of your password.
- You must notify us immediately at support@shifthain.com of any unauthorized access or breach.
- We are not liable for any loss or damage arising from your failure to secure your account.
- We reserve the right to suspend accounts showing signs of unauthorized access for your protection.
3. Acceptable Use Policy
You agree to use ShiftHain.Com only for lawful purposes. You shall NOT:
- Submit false, misleading, or fabricated professional information, qualifications, or work experience.
- Impersonate any person or entity or misrepresent your affiliation with any organization.
- Use the platform to spam, harass, threaten, or send unsolicited communications to employers.
- Upload content that is defamatory, obscene, pornographic, or violates the Information Technology Act, 2000.
- Upload content that promotes hatred, discrimination, or violence based on religion, caste, gender, race, or disability — in violation of applicable Indian laws including the SC/ST (Prevention of Atrocities) Act.
- Use automated bots, scrapers, or scripts to access or extract data from the platform.
- Attempt to reverse engineer, decompile, or tamper with platform software.
- Circumvent, disable, or interfere with security-related features of the platform.
4. Job Applications & Employer Interactions
- By applying to a job, you consent to sharing your ShiftHain.Com profile and resume with that specific employer.
- ShiftHain.Com does not guarantee job placement, interview calls, or employment outcomes.
- We are not responsible for the accuracy, legality, or genuineness of job listings posted by employers.
- If you suspect a fraudulent job listing, report it immediately to support@shifthain.com.
- No employer on ShiftHain.Com is authorized to charge you any fee for job applications or placement — report any such demands immediately.
5. User-Generated Content (Feed & Posts)
By posting content on the ShiftHain.Com Feed (posts, comments, polls), you:
- Grant ShiftHain.Com a non-exclusive, royalty-free, worldwide license to display and distribute such content on the platform.
- Represent that you own or have the right to post such content.
- Agree that content must be professional, truthful, and not violate third-party intellectual property rights.
- Acknowledge that ShiftHain.Com may remove content that violates these Terms or applicable law.
ℹ️ Note: ShiftHain.Com acts as an "intermediary" under Section 2(1)(w) of the IT Act, 2000 and shall comply with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
6. Intellectual Property
All content, trademarks, logos, software, and technology on ShiftHain.Com are the intellectual property of ShiftHain Technologies Private Limited, protected under the Trade Marks Act, 1999 and the Copyright Act, 1957. You may not copy, reproduce, distribute, or create derivative works without prior written permission.
7. Disclaimer of Warranties
The platform is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant uninterrupted or error-free service, accuracy of job listings, or suitability of candidates. Nothing in these Terms limits any rights you may have under applicable consumer protection laws including the Consumer Protection Act, 2019.
8. Limitation of Liability
ShiftHain.Com's aggregate liability to you for any claim arising from your use of the platform shall not exceed INR 1,000 (Rupees One Thousand only). We shall not be liable for indirect, consequential, special, or punitive damages including lost employment opportunities. This limitation does not apply to liability arising from gross negligence, fraud, or breach of data protection laws.
9. Account Termination
We may suspend or permanently terminate your account, with or without notice, if you:
- Violate these Terms of Service.
- Provide false or fraudulent information.
- Engage in abusive, discriminatory, or illegal conduct on the platform.
You may delete your account at any time via Profile Settings. Upon deletion, your data will be handled per Section 6 of the Privacy Policy.
10. Governing Law & Dispute Resolution
- These Terms are governed by the laws of India.
- Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through mutual negotiation within 30 days.
- Unresolved disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual consent.
- The seat of arbitration shall be Bangalore, India, and proceedings shall be conducted in English or Hindi.
- Nothing herein prevents either party from seeking interim relief from a competent court.
- Subject to arbitration, the courts at Bangalore shall have exclusive jurisdiction.
11. Amendments
We reserve the right to modify these Terms at any time. Changes will be notified via email and/or platform notice at least 7 days before they take effect. Continued use after the effective date of changes constitutes your acceptance of the revised Terms.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable under Indian law, the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ShiftHain Technologies Private Limited with respect to your use of ShiftHain.Com and supersede all prior agreements or understandings.
14. Grievance Redressal
For complaints regarding content, account, or any violation, contact our Grievance Officer within 30 days of the issue:
